THE CONSTITUTION UNDER SIEGE

STATES RIGHTS AT RISK

By Mel Ingram

April 13, 2010

The modus operandi of President Obama and his Progressive regime is to execute a series of carefully planned moves that are specifically designed for the federal take-over of power from the states.  While their plan is to implement a European style of socialism, their actions are likely to cause the demise of the Union, as we know it.  Completely ignoring the 10th Amendment, their plan places States Rights at risk. In retrospect, we can recognize their pattern by summarizing the primary steps they have already taken.

First, elect a charismatic President to boggle the minds of the "sheep", and then have him appoint Progressive zealots to every important post in his Administration, including 'Czar' positions.

Second, encourage the Congress to legislate the takeover of health care by demonizing the mean, greedy Insurance Industry, implementing a plan that either will bury that industry or turn it into a premium collection agency for the government, while unmercifully taxing the middle-class under the guise of taxing only the "rich", and by substituting a socialist, European-like rationing of health care that makes doctors and nurses unwilling pawns of the government.

Third, under the guise of 'saving jobs' borrow huge sums on tax-payers’ credit to 'bail-out' shaky corporations that are 'too big to fail', then take over control of whole industries as majority stockholder.  Dictate corporate management pay scales and bonus structures, and then by threat of negative administrative policies and/or legislation, coerce other corporations to implement similar pay policies and other actions desired by the ruling Progressive apparatus.

Fourth, pass legislation to takeover the energy distribution system with insidious Cap & Trade/Tax legislation that mesmerizes the populous with visions of green earth jobs.  Strangle the energy industry with unreachable mileage goals for vehicles and untenable goals for using replenishable sources of energy – including cost-prohibitive distribution systems.  Promote construction of nuclear energy plants as an expensive alternative to oil and gas. Refuse to create a national policy for the disposal of dangerous accumulations of nuclear waste.  Then throw the opposition party a bone by freeing-up the unexplored reaches of off-shore Atlantic states for oil drilling, while declaring ready-to-drill lands in Alaska, middle America and offshore Pacific states to be sacrosanct from oil exploration.  Of course, it could take well over seven years of litigation and environmental testing before it is possible to drill even the first offshore well on the Atlantic seaboard.  Predictably, the Progressive administration will plan no new refineries, while they deliberately allow our gasoline refineries to languish and fade away as antiquities of the past.

Fifth, follow-up with a takeover of Higher Education by kicking the useless, greedy middlemen - the Banks - out of the college loan business and substitute a system of combination grant/loans that dictate who gets to go to which college and which ones have to repay what percentage of the loan/grant, if any at all.

The Progressives plan to implement these central government authority-assertion moves, each of which diminishes the roll of State and Local governments.  Obviously, they are conspiring to convert the USA into a full-blown system of European-like socialism that would make Karl Marx envious.

 Their key moves consist of:

i)                    Overt appeals to the "something-for-nothing" entitlement mentality of the weak masses.

ii)                   Usurping the constitutional authority intended to be wielded by the People as they distribute governmental powers to the States, while growing Central government bureaucracy to epic proportions.

iii)                 Reliance upon the apathy of average American people, permitting the Progressive Socialists to implement their insidious plans.

Patrick Henry feared that a minority could establish such a strong central government that the majority would be unable to alter or abolish the regime, regardless of how evil such central power might ultimately become:

In "The Federal Absorption of the States", Patrick Henry rhetorically asked, "What, sir, is the genius of democracy? . . . whenever any government shall be found inadequate, or contrary to those purposes, a majority of the community hath an indubitable, unalienable, and indefeasible right to reform, alter, or abolish it, in such . . . manner as shall be judged most conducive to the public weal. This, sir, is the language of democracy -- that a majority of the community have a right to alter government when found to be oppressive. But how different is the genius of your new Constitution from this? How different from the sentiments of freemen, that a contemptible minority can prevent the good of the majority!"

It seems clear that Robert Yates was fearful that the constitution was so constructed that the right of local rule by the individual states would be placed in jeopardy of abolishment:

Robert Yates to John Jay ...

"Mr. Jay, my greatest concern is that the new constitution will create a central government so powerful that it might make each state government meaningless.  Local people know their areas the best.  Local people should decide what is best for their state. The state government must be guaranteed of certain power so that it will have its decision making power not be taken away by the federal government."

 (Mr. Yates, a biographical note)

“But to secure ratification, the 10th Amendment was added.  And it was supposed to be for ‘strict constructionists’....    The protection for the diminution of state power, that Yates foretold, would surely occur!”

Then, there is Ben Shapiro, who asked, "Whatever happened to states' rights? It's not too late to assert power over leviathan federal government."  Shapiro was writing about this statement by Texas Governor Perry:

 http://www.worldnetdaily.com/index.php?pageId=95012

"I believe that our federal government has become oppressive in its size, its intrusion into the lives of our citizens and its interference with the affairs of our state… I believe that returning to the letter and spirit of the U.S. Constitution and its essential 10th Amendment will free our state from undue regulations, and ultimately strengthen our union."

Shapiro went on to opine that Perry had issued "a clarion call for more local sovereignty, for less command-and-control from above."  Then he asked, "But is it too late for states to regain their status in the great struggle for policymaking power implemented by the Constitution?"

It is about time we recognize that - by exercise of its sheer pomposity and size - all too often the actions of our Federal Government tend to:

Amendment 10 - Powers of the States and People:

“The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

These words are abundantly clear.  Contrary to what Progressives may say, these words are not ambiguous!  They mean what they say, and say what they mean.  There can be no equivocation.  We, the people, did not delegate to the Federal Government the power to grab the oversight of insurance companies away from state control.  Nor were those powers relinquished to the Feds.   Distorting and twisting the interstate commerce clause, the Progressives usurp authority under the Constitution by passing an unconstitutional law that forces individual citizens to purchase health insurance.  The Constitution in no way allows a Central government the power to require the purchase of any particular product; certainly not health insurance; categorically not GM products; and, definitely not handy-dandy baby diapers!

We must ask ourselves, if it is too late to actually do anything about it. How can we resist Federal Power?  And I'm NOT talking about secession or overt rebellion. I'm talking about taking back our country.  I'm speaking about returning the direction of the USA to the republic form of government to which she was originally destined. I'm suggesting that we reclaim our greatness by honoring God and family values.  I'm touting a system of free enterprise and capitalism.  I'm in favor of as little restriction and regulation as necessary to guard against monopolistic practices.

I'm hoping for a grass roots movement that starts at the bottom of the political chain by infiltrating both parties with citizens willing to run for offices starting at the precinct level and on into the state houses – all the way to the halls of the Congress!  And, folks, the Tea Party movement just may be the ticket to that end.

We can, and we must reverse the sharp left direction this regime has taken our nation.  We must take back our government by using our voting power to place into office, minor and major, new and responsive representation.  What grass roots organization have you joined?  Which precinct doors have you knocked on lately?  What is your voting record?  What have you volunteered to do that may be of help?   Have you considered running for precinct committeeman? What politician did you last support with a donation?  To which party apparatus did you last lend monetary support?

I submit that these challenges, however poorly presented, are intended to peak whatever portion of patriotism is capsulated within you as you deliberate these words.

 What do you think?
