 As any student of mine knows .... Rights come from God ... the Second Amendment only enumerates that right ... the First Amendment does not grant freedom of Religion .... it simply states a right granted by God.

 The White House has attempted to rewrite the Bill of Rights and thus make it available to be rewritten with "revisions" in the future. Resist rewriting/amending the Constitution.

God Save the Republic.


The Constitution is not a living breathing organism from which you are allowed to chose those freedoms that suit you on any given day.  The first eight amendments are about restrictions on a government that impinges on your inherent rights.  This is not a cafeteria where you are allowed to chose your rights; its about restricting government's powers over your right to exercise your inherent freedoms. 

Surrender of these rights in not an option. The men and women of this country struggle to receive these God given rights and to protect future generations so they will have them too.

Americans buy record numbers of guns for Christmas!

According to the FBI, over 1.5 million background checks on customers were requested by gun dealers to the National Instant Criminal Background Check System in December. Nearly 500,000 of those were in the six days before Christmas.

It was the highest number ever in a single month, surpassing the previous record set in November.

On Dec 23 alone there were 102,222 background checks, making it the second busiest single day for buying guns in history.

A bill by state Rep. Leo Berman exempting Texas-made firearms, gun accessories and ammunition sold within the state from federal regulation and law -- including registration -- was heard in a House committee on Monday.
The bill also provides for the Texas Attorney General's office to defend Texans who run afoul of the federal government because of this law.
Berman, a Tyler Republican who has pushed several "states' rights" measures this legislative session, said his bill would affect more than 300 manufacturers in the state.
"Under the 9th and 10th Amendments of the U.S. Constitution, states have responsibility for regulating intrastate commerce," Berman said. "The federal government has no role."

8 Grocery Employees Stabbed in Tennessee

The attacker, chasing one victim into the store's parking lot, was subdued by Chris Cope, manager of a financial services office in the same small shopping center, Higgins said.

Cope said he grabbed a 9mm semiautomatic pistol from his pickup truck when he saw the attacker chasing the victim "like something in a serial killer movie."

When he turned around and saw my pistol, he threw the knife away, put his hands up and got on the ground," Cope told The Associated Press. "He saw my gun and that was pretty much it."

Police arrived within minutes and took the attacker into custody.

A man's 96-hour, involuntary detention in a mental health facility was not a commitment and should not have disqualified him from obtaining a permit to acquire a gun, the state Supreme Court said Tuesday.

The court said David Nelson's "detention" for evaluation and treatment in 2003 did not result in his being "committed" to a mental health facility for purposes of restricting his right to acquire a gun. In ruling in Nelson's favor, the Supreme Court reversed and remanded a lower court decision that had sided with the Callaway County sheriff who had denied the gun permit.

"The way he saw it," the earlier ruling "painted him as being crazy," Nelson's attorney, Geoffrey Preckshot said of his client Tuesday. "He's feeling a tremendous amount of vindication in having his good name restored. He isn't crazy."

TEXAS   new gun-toting law has surprise backer: ACLU

In part ...."House Bill 823, which was passed by Texas legislators during the 2005 regular session, states that a person "is presumed to be traveling" and is legally permitted to carry a handgun in his car or truck if he is (1) in a private motor vehicle, (2) not engaged in criminal activity, (3) not prohibited by law from possessing a firearm, (4) not a member of a "criminal street gang" and (5) not carrying the handgun "in plain view."

The bill was vigorously opposed by prosecutors and law enforcement officials who believed it would increase the number of guns on the state's streets and highways and do more harm than good.

In the column, I quoted Harris County District Attorney Chuck Rosenthal, who said that in his jurisdiction, "It is still going to be against the law for (unlicensed) persons to carry handguns in autos." And I suggested that Texans should probably think twice before stashing pistols in their glove boxes or under their bucket seats.

That warning prompted the Henson-initiated e-mail exchange.

"The new statute says juries MUST presume a driver is traveling and therefore legally carrying a gun unless the state disproves one of the five elements," the ACLUer insisted. "State Rep. Terry Keel, who authored the bill, says: 'In plain terms, a law-abiding person should not fear arrest if they are transporting a concealed weapon in a motor vehicle.' ...

"The story here isn't that the law was poorly written. The story here is that some prosecutors are so arrogant they think they don't have to follow the law."

Still, Henson cautioned: "I agree that drivers should be wary. Until this is settled (in the courts), they risk arrest."



  1. Bring a gun. Preferably, bring at least two guns. Bring all of your friends who have guns.
  2. Anything worth shooting is worth shooting twice. Ammo is cheap-life is expensive.
  3. Only hits count. The only thing worse then a miss is a slow miss.
  4. If your shooting stance is good, you're probably not moving fast enough or using cover correctly.
  5. Move away from your attacker. Distance is your friend. (Lateral and Diagonal movement are preferred.)
  6. If you can choose what to bring to a gunfight, bring a long gun and a friend with a long gun.
  7. In ten years nobody will remember the details of caliber, stance, or tactics. They will only remember who lived.
  8. If you are not shooting, you should be communicating, reloading, and running.
  9. Accuracy is relative: most combat shooting standards will be dependent on "pucker factor" then the inherent accuracy of the gun. Use a gun that works EVERY TIME. "All skill is in vain when an Angel blows the powder from the flintlock of your musket."
  10. Someday someone may kill you with your own gun, but they should have to beat you to death with it because it is empty.
  11. Always cheat, always win. The only unfair fight is the one you lose.
  12. Have a plan.
  13. Have a back-up plan, because the first one won't work.
  14. Use cover or concealment as much as possible.
  15. Flank your adversary when possible. Protect yours.
  16. Don't drop your guard.
  17. Always tactical load and threat scan 360 degrees.
  18. Watch their hands. Hands kill. (In God we trust. Everyone else, keep your hands where I can see them.)
  19. Decide to be aggressive ENOUGH, quickly ENOUGH.
  20. The faster you finish the fight, the less shot you will get.
  21. Be polite. Be professional. But, have a plan to kill everyone you meet.
  22. Be courteous to everyone, friendly to no one.
  23. Your number one option for personal security is a lifelong commitment to avoidance, deterrence, and de-escalation.
  24. Do not attend a gun fight with a handgun, the caliber of which does not start with anything smaller then "4".
  25. Your can't miss fast enough to win.

Texas Carry Law .... as defining the term traveling :

New Law on Carrying Firearm while “Traveling”

(House Bill 823, 79th Regular Legislative Session, amending Penal Code

Sections 2.05 and 46.15)

In Texas, it is generally unlawful to carry a handgun in public, including within a private

vehicle. However, Texas also recognizes several exceptions. One such exception is applicable

when the citizen is “traveling.”

“Traveling” has never been defined by the legislature. Texas courts have said that in

general, the determination of whether a citizen is traveling is to be determined on a case by case

basis, depending on the specific circumstances. Texas courts have generally considered the

distance, time, and mode of travel in determining whether the citizen is traveling and have found

“traveling” to generally encompass overnight travel, through multiple counties.

The change in the law, effective September 1, 2005, places the burden of proof on the

State rather than the citizen as to whether or not the citizen was traveling. In other words, the

State must prove beyond a reasonable doubt that the citizen was NOT traveling, rather than the

citizen having to prove that he or she WAS traveling. The new law also describes the

circumstances under which a citizen will be presumed by a jury to be traveling.

Some local law enforcement and prosecuting agencies have indicated that they will

continue to make arrests and file charges when they encounter citizens carrying handguns in

motor vehicles and will allow juries to determine whether citizens were traveling. DPS has no

authority to determine or to comment on how this law will be enforced by the various local law

enforcement and prosecuting agencies in the State of Texas.

Having guns at gun shows can be constitutionally protected "expressive conduct," a form of free speech under the First Amendment, U.S. District Judge Martin Jenkins said in an order Tuesday, rejecting the county's motion to dismiss a lawsuit filed by gun-show promoters Russell and Sallie Nordyke."

Have fun lugging that 'iron'. Rhetorically, do we have a Constitutional right to carry an UNconcealed weapon without a permit? I've always wondered if I could carry my .45 in public in my canvas G.I. holster with the grip strap and no flap. I think you ought to get a 2nd Amendment page going. That would be a lot more fun for me. R

Answer ... There is no constitutional right to the Unconcealed weapon in public. In private you can do as you please .... except in those states that violate the constitution altogether and like D.C. seem to ban all guns... K
